Terms of Service

Welcome to Fan Vault! These Terms of Service govern your use of Fan Vault (accessible via fanvault.vip) and any associated services provided by Red Lantern Limited (referred to as “we,” “us,” or “our”). By registering for an account or otherwise using Fan Vault, you agree to these Terms of Service. If you do not agree, you must not use Fan Vault.

1. About Us:

Fan Vault is a platform operated by Red Lantern International Limited, which allows Creators to monetize their content and interact with Fans. Our registered office is at 9 Athelney Street, London, SE6 3LE, UK and you can contact us at contact@fanvault.vip.

2. Definitions:

– “Creator” means a User who uploads, posts, or shares content on Fan Vault for Fans to access.

– “Fan” means a User who accesses and/or subscribes to a Creator’s content.

– “Content” means any material (including text, images, video, audio, and other media) uploaded to Fan Vault.

– “Fan Vault,” “we,” or “us” refers to the platform and its parent company, Red Lantern Limited.

3. Eligibility to Use Fan Vault:

By using Fan Vault, you confirm that:

– You are at least 18 years old.

– You are legally permitted to access Fan Vault in your country or region.

– You have not been previously banned or had your account terminated on Fan Vault for violating any of our terms or policies.

4. Changes to the Terms of Service:

We may modify these Terms of Service at any time. If we make material changes, we will notify you via email or through your Fan Vault account. Your continued use of Fan Vault after such modifications constitutes your acceptance of the updated Terms of Service.

5. Your Account:

a. Account Registration:

– You must create an account to access certain features of Fan Vault.

– You are responsible for ensuring that all information provided during registration is accurate and kept up to date.

b. Account Security:

– You are responsible for maintaining the confidentiality of your login credentials.

– Notify us immediately at contact@fanvault.vip if you suspect unauthorized use of your account.

c. Account Termination:

– You may delete your account at any time via your account settings. Upon termination, you may no longer access any Content you’ve uploaded or subscribed to, and we reserve the right to delete or retain your Content in line with our Privacy Policy.

6. Your Commitments to Us:

When you register with and use Fan Vault, you make the following commitments:

7. Rights we have, including to suspend or terminate your account:

We can but are not obligated to moderate or review any of your Content to verify compliance with the Terms of Service (including, in particular, our Acceptable Use Policy) and/or any applicable law.

It is our policy to suspend access to any Content you post on Fan Vault that we become aware may not comply with the Terms of Service (including, in particular, our Acceptable Use Policy) and/or any applicable law while we investigate the suspected non-compliance or unlawfulness of such Content. If we suspend access to any of your Content, you may request a review of our decision to suspend access to the relevant Content by contacting us at [contact@fanvault.vip]. Following our investigation of the suspected non-compliance or unlawfulness of the relevant Content, we may take any action we consider appropriate, including reinstating access to the Content or permanently removing or disabling access to it without needing to obtain any consent from you and without giving you prior notice. You agree to promptly provide us with all reasonable assistance at your own cost (including by providing copies of any requested information) during our investigation. We will not be responsible for any loss you suffer arising from the suspension of access to your Content or any other steps we take in good faith to investigate any suspected non-compliance or unlawfulness of your Content under this section.

If we suspend access to or delete any of your Content, we will notify you via email or electronic message to your Fan Vault account, but we are not obligated to give you prior notice of such removal or suspension.

We reserve the right, at our sole discretion, to terminate your agreement with us and your access to Fan Vault for any reason by giving you 30 days’ notice via email or an electronic message to your Fan Vault account. We may also suspend access to your User account or terminate your agreement with us and your access to Fan Vault immediately and without prior notice:

– If we believe you have or may have seriously or repeatedly breached any part of the Terms of Service (including, in particular, our Acceptable Use Policy), or if you attempt or threaten to breach any part of the Terms of Service in a way that has or could have serious consequences for us or another User; or

– If you take any action that, in our opinion, has caused or is reasonably likely to cause us to suffer a loss or otherwise harm the reputation of Fan Vault.

If we suspend access to your User account or terminate your agreement with us and your access to Fan Vault, we will notify you. During any period when access to your User account is suspended, any Fan Payments that would otherwise have fallen due during the suspension period will be suspended, and we may withhold all or any part of the Creator Earnings due to you but not yet paid out in accordance with section 11 of the Terms of Use for Creators.

Upon termination of your account, we may handle your Content in any appropriate manner in accordance with our Privacy Policy (including by deleting it). You will no longer be entitled to access your Content. Fan Vault does not have a technical facility to allow you to access your Content following the termination of your account.

We can investigate any suspected or alleged misuse, abuse, or unlawful use of Fan Vault and cooperate with law enforcement agencies in such investigations.

We can disclose any information or records in our possession or control about your use of Fan Vault to law enforcement agencies in connection with any law enforcement investigation of any suspected or alleged illegal activity, to protect our rights or legal interests, or in response to legal process.

We may change the third-party payment providers used to process payments on Fan Vault. If we do so, we will notify you and store applicable details on your Fan Vault account.

Other than Content (which is owned by or licensed to Creators), all rights in and to Fan Vault and its entire contents, features, databases, source code, and functionality are owned by us and/or our licensors. Such material is protected by copyright and may also be protected by trademark, trade secret, and other intellectual property laws.

We are the sole and exclusive owners of any and all anonymized data relating to your use of Fan Vault, and such anonymized data can be used by us for any purpose, including for commercial, development, and research purposes.

8. What we are not responsible for:  

We will use reasonable care and skill in providing Fan Vault to you, but there are certain things we are not responsible for, as set out below:

– We do not authorize or approve Content on Fan Vault, and views expressed by Creators or Fans on Fan Vault do not necessarily represent our views. We do not own or control the Content posted on Fan Vault, and we are not responsible for it.

– You acknowledge that you may be exposed to Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose.

– We will not be responsible for any loss suffered by you arising from the acts or omissions of any other User, whether that User is a Fan or Creator, or their Content.

– We do not guarantee that Fan Vault will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs, and platform to access Fan Vault. You should use your own virus protection software.

– We are not responsible for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, programs, data, or other proprietary material due to your use of Fan Vault or your downloading of any Content on it or any website linked to it.

– While we try to make sure that Fan Vault is available for your use, we do not promise that Fan Vault will always be available or accessible.

9. Fees and taxes  

We are responsible for ensuring that all subscription payments made via Fan Vault are processed securely and in accordance with applicable laws.

Creators are solely responsible for determining and meeting their own obligations under applicable laws to report and pay any applicable taxes in relation to their earnings on Fan Vault.

If you are a Creator, you may be required to provide us with information such as your tax identification number or evidence of your tax registration, as applicable, before you can withdraw earnings from Fan Vault.

We may deduct any amounts that we are required to deduct or withhold by law from payments due to Creators.

If you are a Fan, you agree that you are responsible for all amounts payable under your Fan Payment, including any applicable taxes.

10. Intellectual property rights – ownership and licenses

a. Ownership of Content:

You confirm that you own all intellectual property rights (examples include copyright and trademarks) in your Content or that you have obtained all necessary rights to your Content required to grant licenses to us and other Users. This includes any rights necessary for activities in any territory where **Fan Vault** is accessible, particularly in Nigeria, the United States, the United Kingdom, and the European Union.

b. Grant of license to us:

By posting Content on Fan Vault, you grant Red Lantern Limited a license to perform acts restricted by intellectual property rights (including copyright) in such Content. These acts may include reproducing, distributing, displaying, performing, adapting, translating, and creating derivative works of your Content, among others.

c. Scope of the license:

The license you grant us is:

– Perpetual: It continues even after your agreement with us ends.

– Non-exclusive: You can grant similar rights to others.

– Worldwide: It applies globally.

– Royalty-free: You will not be paid for the license.

– Sublicensable and assignable: We can grant sublicenses or transfer this license to others.

We may use this license to enhance the operation and functionality of Fan Vault, such as adding watermarks, text, or stickers to your Content. However, we will not sell your Content to other platforms, though we may transfer the license in case of a sale of Red Lantern Limited or its assets.

d. Infringement notifications:

Although we are under no obligation to monitor or police third-party use of your Content, we reserve the right to submit notifications of infringement on your behalf to third-party websites or services dealing in infringing copies of your Content. If we request your assistance, you agree to provide all necessary information and consents to facilitate this process.

e. Waiver of moral rights:

You waive any moral rights under applicable law to object to derogatory treatment of your Content. This waiver enables us to make necessary modifications to your Content, such as adding watermarks, without infringing your rights.

11. Linking to and from Fan Vault  

a. Links to Fan Vault:

– You may link to the Fan Vault homepage, provided the link is fair, legal, and does not damage our reputation or take advantage of it.

– Links must not suggest any form of association, approval, or endorsement by us unless expressly authorized.

b. Links from Fan Vault:

– Any links to third-party websites or resources on Fan Vault are provided for your convenience only.

– We are not responsible for the content, availability, or any loss or damage that may arise from using third-party websites.

c. Domain names:

– If Fan Vault allows Creators to register domain names containing the Fan Vault trademark or similar terms, the domain must:

 1. Be registered by the Creator.

 2. Redirect exclusively to the Creator’s Fan Vault profile.

 3. Obtain prior written approval from Red Lantern Limited and comply with a licensing agreement.

Failure to adhere to these conditions may result in legal action, including domain disputes.

12. How do I delete my account?  

If you want to delete your Fan Vault account, follow the instructions below:

a. For Fans:

– The deletion of your account will take place within a reasonable time following your request.

b. For Creators:

– Once you initiate the “delete account” process, your account will remain open until the last day of your Fans’ paid subscription period. Afterward, you will receive your final payment, and your account will be deleted.

c. For Users who are both Fans and Creators:

– Your account will be deleted in two stages: first as a Fan and then as a Creator.

d. Post-deletion process:

– Once your account is deleted, you will no longer be charged, nor will you have access to your former Fan Vault account or its Content. All subscriptions will also be deleted and cannot be renewed.

– You will receive an email confirmation upon the successful deletion of your account.

– Following deletion, we may handle your Content as outlined in our Privacy Policy (which may include deleting it), and you will no longer have access to it.

– Fan Vault does not provide a technical facility to retrieve your Content after account termination.

13. Who is responsible for any loss or damage suffered by you?

a. General liability:  

We do not exclude or limit our liability where it would be unlawful to do so. This includes:

– Liability for death or personal injury caused by our negligence or that of our employees, agents, or subcontractors.

– Fraud or fraudulent misrepresentation.

b. Liability for consumer Users:

– Fan Vault, Red Lantern Limited, and their employees, owners, representatives, or agents are not liable for:

 – Loss of profit, business, or revenue.

 – Business interruption, opportunity, or anticipated savings.

For consumer Users residing in:

1. Nigeria: Our total liability is limited to ₦50,000 per claim.

2. United States: Our total liability is limited to $250 per claim.

c. Liability for business Users:

– For Creators and other business Users, Fan Vault and Red Lantern Limited:

 – Exclude all implied conditions, warranties, or terms not expressly included in these Terms of Service.

 – Are not responsible for any unforeseeable loss or damage caused by breaches of the Terms of Service.

Specifically, we will not be liable for:

– Loss of data or information, including Content.

– Indirect or consequential loss.

– Damage caused by cyberattacks, malware, or other harmful material arising from using Fan Vault.

– Unauthorized copying or distribution of your Content by third parties.

– Doxing (disclosure of your personal information by other Users or third parties).

– Delays or failures arising from events outside our reasonable control.

Our total liability to business Users for any claims is limited to the greater of:

– 100% of the fees paid to us in connection with your use of Fan Vault.

– $1,000.

14. General terms  

a. Enforceability:

– If any part of the Terms of Service is found unenforceable, the rest remains in effect.

– Our failure to enforce any part of these Terms is not a waiver of our rights.

b. Transfer of rights:

– You may not transfer your rights or obligations under these Terms without our prior consent.

– We reserve the right to transfer or delegate our rights and obligations under these Terms in case of ownership changes or for legal compliance.

c. Entire agreement:

These Terms of Service constitute the complete agreement between you and Red Lantern Limited, superseding prior agreements or understandings.

15. Terms relating to disputes  

a. Governing law:

– For Fans: Your agreement is governed by English law, and disputes may be subject to the mandatory rules of your home country.

– For Creators and business Users: English law applies to disputes, including non-contractual ones.

b. Limitation of claims:

– Claims must be filed within one year of the incident or discovery, whichever is earlier, except where prohibited by law.

Your agreement with us also incorporates:

– Privacy Policy: Explains how we use personal data.

– Acceptable Use Policy: Outlines permissible use of Fan Vault.

– Complaints Policy: Details how to file and address complaints.

BY USING OUR WEBSITE AS A FAN, YOU AGREE TO THESE TERMS – PLEASE READ THEM CAREFULLY

1. Introduction

These Terms of Use for Fans apply if you use Fan Vault as a Fan (“you” and “your”). They form part of your agreement with Red Lantern Limited (“we,” “us,” “our”).

2. Definitions and Related Terms

Terms defined in the Terms of Use for All Users apply here. In addition:

– VAT: Value-added tax or equivalent charges in any jurisdiction.

– Tax: All forms of governmental charges, duties, or levies, in the UK or elsewhere.

Other applicable terms:

– Terms of Use for All Users

– Privacy Policy: Explains how we handle your data.

– Acceptable Use Policy: Lists permitted and prohibited actions.

– Complaints Policy: Outlines the complaint process.

3. Your Commitments

You warrant that:

– You are 18 years or older (or of legal contracting age in your location).

– Your use of Fan Vault complies with all applicable laws where you reside.

– You can and will make payments (if required) for Content or services on Fan Vault.

4. Content on Fan Vault

As a Fan, you promise that any Content you post:

– Complies fully with our terms, including the Acceptable Use Policy.

– Is owned by you, or you hold the necessary licenses or permissions.

You agree to indemnify us against any losses or damages if these warranties are false.

5. Mature Content

Fan Vault may contain mature material. You acknowledge this and agree we are not liable for any issues arising from your viewing of such Content.

6. Subscriptions and Fan Transactions

When entering transactions with Creators:

– We only facilitate transactions; we are not a party to any Fan/Creator agreements.

– Payments:

 – Exclusive of VAT unless stated.

 – Processed in your card’s currency (additional fees may apply).

 – Auto-renew by default unless you disable the “Auto-Renew” switch.

– Refunds and Chargebacks:

 – Unjustified refund or chargeback requests may lead to account suspension or deletion.

– Wallet Credits:

 – Prepaid amounts are non-refundable.

7. Account Suspension

If your account is suspended, any Fan Payments due during the suspension will also be suspended.

BY USING OUR WEBSITE AS A CREATOR YOU AGREE TO THESE TERMS – PLEASE READ THEM CAREFULLY.

1. Introduction

These Terms of Use for Creators apply if you use Fan Vault as a Creator (also referred to as “you” and “your” in these Terms). These terms form part of your agreement with Red Lantern Limited.

2. Interpretation

  Defined terms in these Terms of Use for Creators carry the same meanings as in our main Terms of Use. Additionally:

  a. VAT means value-added tax and other similar taxes, charges, duties, or levies imposed by any jurisdiction.

  b. Tax includes all forms of taxes, charges, levies, and liabilities, whether statutory, governmental, state, or local.

3. Other Terms Applying to Your Use of Fan Vault

  You also agree to the following terms:

  a. Our Terms of Use;

  b. Our Privacy Policy, which details how we collect and use your personal data;

  c. Our Acceptable Use Policy, which outlines prohibited actions on Fan Vault;

  d. Our Complaints Policy, which explains how complaints are handled.

4. Fees for Creators

  We charge a 30% fee on all transactions made through Fan Vault. This fee is deducted before any payment is made to you.

5. Setting Up Your Creator Account

  To set up your Creator account, you must:

  a. Upload a valid form of ID and two photos according to our requirements;

  b. Add your bank account or other payment details;

  c. Select a Payout Option for your Creator Earnings;

  d. Provide additional information depending on your country of residence;

  e. You may need to submit further verification for age or identity at any time.

  Once your account is set up, you can set your Fan subscription price and begin uploading Content. Fans will be able to subscribe to your account.

6. Personal Legal Responsibility of Creators

  Only individuals can be Creators. If you have an agent or third party assisting you, this does not affect your legal responsibility. You remain personally accountable for complying with these terms.

  a. Fan Payments are exclusive of VAT, which will be added as applicable.

  b. Upon confirmation of a transaction, you must provide the promised Content or services to your Fan. You agree to indemnify Red Lantern Limited for any breach.

7. Content – General Terms

  By posting Content on Fan Vault, you agree to the following:

  a. Content is not confidential, and you grant Fans access to view it for personal, lawful use.

  b. You warrant that:

     i. The Content complies with all relevant Terms of Service;

     ii. You hold all necessary rights to post and distribute the Content;

     iii. You own or have the necessary licenses for the Content;

     iv. If using third-party materials, you have obtained the appropriate rights and permissions.

     v. Content is of satisfactory quality, as described, and fit for purpose.

  c. You agree to indemnify Red Lantern Limited if any of the above warranties are untrue.

  d. Red Lantern Limited is not responsible for the Content and does not endorse or monitor it.

  e. You act as custodian for records related to your Content.

8. Advertising on Fan Vault

  If you post Content for promotional purposes, it is considered Advertising Content. You must comply with the following:

  a. Advertising Content must not:

     i. Promote discrimination, harm, or illegal activities;

     ii. Advertise cigarettes, drugs, or prescription medicines;

     iii. Encourage harmful or excessive behavior, particularly in relation to alcohol or gambling.

  b. Transparency Requirement: You must mark all Advertising Content with the hashtag #ad in the caption before posting.

9. Co-authored Content

  If your Content includes others, you must ensure:

  a. The individuals are either Creators on Fan Vault or consenting adults;

  b. You have written consent from all parties involved;

  c. You must tag other Creators in Co-authored Content when applicable;

  d. You are responsible for obtaining any necessary licenses from other authors of the Content.

  e. Earnings from Co-authored Content will only be paid to the Creator who uploads it. Any revenue-sharing agreements are between Creators and not the responsibility of Red Lantern Limited.

  f. You agree to release Red Lantern Limited from any claims arising from Co-authored Content.

10. Payouts to Creators

   a. Payments are processed by a third-party provider approved by us.

   b. Our fee will be deducted, and the remaining Creator Earnings will be held by Red Lantern Limited on your behalf.

   c. Your earnings will be available for withdrawal once they appear in your Fan Vaultaccount.

   d. To withdraw, your balance must meet the minimum payout amount, which can be found on the Banking page of your account.

   e. Fan Payments and Creator Earnings are transacted in Nigerian Naira, and some payout options may incur additional fees from your bank or e-wallet service.

   f. In case of a chargeback or refund request from a Fan, we may deduct the equivalent amount from your Creator Earnings.

11. Circumstances in which we may withhold Creator Earnings:

a. We may withhold all or any part of the Creator Earnings due to you but not yet paid out:

i. If we think that you have or may have seriously or repeatedly breached any part of the Terms of Service;

ii. If you attempt or threaten to breach any part of the Terms of Service in a way which we think has or could have serious consequences for us or another User (including actual or possible loss caused to us or another User); or

iii. If we suspect that all or any part of the Creator Earnings result from unlawful or fraudulent activity, either by you or by the Fan who made the Fan Payment resulting in the Creator Earnings,

for as long as is necessary to investigate the actual, threatened, or suspected breach by you or the suspected unlawful activity (as applicable). If following our investigation, we conclude that (i) you have seriously or repeatedly breached any part of the Terms of Service; (ii) you have attempted or threatened to breach any part of the Terms of Service in a way which has or could have serious consequences for us or another User (including actual or possible loss caused to us or another User), and/or (iii) the Creator Earnings result from unlawful or fraudulent activity, we may notify you that you have forfeited your Creator Earnings.

b. We may also withhold all or any part of the Creator Earnings due to you but not yet paid out if we receive notice that you have secured, encumbered, pledged, assigned, or otherwise allowed a lien to be placed on Creator Earnings. We undertake no duty to pay Creator Earnings to third-party lienholders and may withhold payment of Creator Earnings until the lien has been removed.

c. We shall not have any responsibility to you if we withhold or forfeit any of your Creator Earnings where we have a right to do so under these Terms of Use for Creators.

d. If we are withholding all or any part of the Creator Earnings due to you and we determine that part of the Creator Earnings withheld by us is unrelated to breaches by you of the Terms of Service or suspected unlawful or fraudulent activity, then we may arrange for you to be paid the part of the Creator Earnings which we determine to be unrelated to breaches by you of the Terms of Service or suspected unlawful or fraudulent activity. However, you agree that if we consider that your breach(es) of the Terms of Service has or may cause us loss, we may withhold all Creator Earnings due to you but not yet paid and we may set off such amounts against any losses suffered by us.

e. If once we have finished our investigation we determine that Creator Earnings are forfeited, we will (unless prohibited by law) use our best efforts to ensure that any Fan Payments which resulted in forfeited Creator Earnings are returned to the relevant Fans who paid such Fan Payments.

12. Promoting Tax compliance and VAT:

a. General:

i. We recommend that all Creators seek professional advice to ensure you are compliant with your local Tax and VAT rules, based on your individual circumstances.

ii. By using Fan Vault as a Creator, you warrant (which means you make a legally enforceable promise) that you have reported and will report in the future the receipt of all payments made to you in connection with your use of Fan Vault to the relevant Tax authority in your jurisdiction, as required by law.

iii. By using Fan Vault as a Creator, you warrant (which means you make a legally enforceable promise) that you will at all times comply with all laws and regulations relating to Tax which apply to you. If, at any point whilst you have a Fan Vault account, any Tax non-compliance occurs in relation to you (including a failure by you to report earnings or the imposition on you of any penalty or interest relating to Tax) or if any litigation, enquiry, or investigation is commenced against you that is in connection with, or which may lead to, any occurrence of Tax non-compliance, you agree that you will:

1. Notify us by email in writing within 7 days of the occurrence of the Tax non-compliance or the commencement of the litigation, enquiry, or investigation (as applicable); and

2. Promptly provide us by email to [contact@fanvault.vip] with:

  a. Details of the steps which you are taking to address the occurrence of the Tax non-compliance and to prevent the same from happening again, together with any mitigating factors that you consider relevant; and

  b. Such other information in relation to the occurrence of the Tax non-compliance as we may reasonably require.

iv. For the avoidance of doubt, you are responsible for your own Tax affairs and we and our subsidiary companies (i) are not responsible for advising you on your Tax affairs and will not be liable in respect of any general information provided on Fan Vault in respect of Tax, and (ii) will not be liable for any non-payment of Tax by Creators.

v. We reserve the right to close your Fan Vault account if we are notified of or become aware of any Tax non-compliance by you.

ACCEPTABLE USE POLICY

BY USING OUR WEBSITE YOU AGREE TO THIS POLICY – PLEASE READ IT CAREFULLY

This Policy applies to your use of Fan Vault and all Content on Fan Vault and forms part of your agreement with us. This Policy sets out what is and is not permitted on Fan Vault.

In this Policy, defined terms have the same meanings as in our Terms of Use.

1. Personal Use Only:

Do not use Fan Vault except for your own personal use and do not sell, rent, transfer, or share your account or any Content obtained from your use of Fan Vault to or with anyone else.

2. Lawful Use:

Only use Fan Vault in a manner and for a purpose that is lawful.

Do not upload, post, display, or publish Content on Fan Vault that is illegal, fraudulent, excessively pornographic, defamatory, hateful, discriminatory, threatening or harassing, or which encourages or promotes violence or any illegal activity.

3. Exploitation of Minors:

Do not use Fan Vault in any way that may exploit, harm, or attempt to exploit or harm any individual under 18 years old, for example by exposing them to inappropriate Content.

4. Prohibited Content:

Do not upload, post, display, or publish Content on Fan Vault that:

a. shows, includes or refers to:

     i. any individual under 18 years old (or which refers to individuals under 18 years old generally); or

     ii. any other individual unless you have written documentation which confirms that all individuals shown or included or referred to in your Content are at least 18 years old, and you have written consent from each individual to use their name or images (or both) in the Content;

b. shows, promotes, advertises, or refers to:

     i. firearms, weapons, or any goods whose sale, possession, or use is subject to prohibitions or restrictions;

     ii. drugs or drug paraphernalia;

     iii. self-harm or suicide;

     iv. incest;

     v. bestiality;

     vi. violence, rape, lack of consent, hypnosis, intoxication, sexual assault, torture, sadomasochistic abuse or hardcore bondage, extreme fisting, or genital mutilation;

     vii. necrophilia;

     viii. urine, scatological, or excrement-related material;

     ix. “revenge porn” (being any sexually explicit material featuring any individual who has not given prior, express and fully informed consent to that material being taken or posted);

     x. escort services, sex trafficking, or prostitution;

c. contains unsolicited sexual content or unsolicited language that sexually objectifies another User or anyone else in a non-consensual way, or contains fake or manipulated sexual content in relation to another User or anyone else (including “deepfakes”);

d. contains, promotes, advertises, or refers to hate speech (Content intended to vilify, humiliate, dehumanize, exclude, attack, threaten, or incite hatred, fear of, or violence against, a group or individual based on race, ethnicity, national origin, immigration status, caste, religion, sex, gender identity, sexual orientation, age, disability, serious disease, or any other protected characteristic);

e. contains or refers to anyone else’s personal data or private or confidential information (such as telephone numbers, location info, names, identity documents, email addresses, log-in credentials, financial info, biometric data, medical records) without express written consent;

f. either:

     i. in the case of Content featuring public nudity, was recorded in or is being broadcast from a location where public nudity is illegal; or

     ii. in the case of Content featuring sexual activities, was recorded in or is being broadcast from a public place where members of the public are reasonably likely to see the activities being performed;

g. gives the impression it is from or is approved, licensed, or endorsed by us or any other person or company;

h. causes or is calculated to cause inconvenience, anxiety, upset, or serious offense to anyone else;

i. is used or intended to be used to extract money or benefits from anyone in exchange for removal of Content; and/or

j. promotes third-party commercial activities or sales (e.g., contests, sweepstakes, product placements, ads, or job postings) without our prior express consent.

5. Harassment and Misuse:

Do not use Fan Vault to stalk, bully, abuse, harass, threaten or intimidate anyone else.

6. Misleading or Deceptive Conduct:

Do not use Fan Vault to engage in misleading or deceptive conduct, or conduct that is likely to mislead or deceive any other User.

7. Intellectual Property Respect:

Respect the intellectual property rights of Creators, including by not recording, reproducing, sharing, or otherwise distributing their Content without authorization.

8. Right Violations:

Do not do anything that violates our or someone else’s rights, including intellectual property, personality rights, privacy, and data protection rights.

9. Impersonation:

Do not impersonate us, one of our employees, another User, or any other person or company, or falsely state or suggest any affiliation with us or any other person or company.

10. Unauthorized Use of Information:

Do not provide false registration information or make unauthorized use of anyone else’s information or Content.

11. Spam or Inauthentic Content:

Do not post or cause to be posted Content which is spam, inauthentic, misleading, repetitive, or low quality.

12. Live Stream Deception:

Do not transmit, stream, or otherwise send pre-recorded audio or video material during a live stream or pass off recorded material as a live stream.

13. Unlawful Communication Methods:

Do not use codewords, signals, or other methods to communicate anything violating this Policy.

14. Reproduction and Distribution:

Do not reproduce, distribute, attempt to download, modify, or create derivative works from Content, except as permitted by the Terms of Service.

15. Malicious Content:

Do not knowingly introduce any viruses, trojans, worms, logic bombs, or other harmful material into Content that could affect Fan Vault.

16. Security and Interference:

Do not use Fan Vault in a way that adversely affects our systems or security or interferes with any other User’s use of Fan Vault.

17. Automated Tools:

Do not use automated tools or processes (e.g., bots, crawlers, spiders, automated scripts) to access or extract information from Fan Vault.

18. Impersonation and Branding:

Do not use Fan Vault’s name, logo, or related materials unless expressly permitted in the Terms of Service or with written consent.

Breaches of this Policy may lead to your account being suspended or terminated, and access to your earnings being revoked, as set out in the Terms of Service.
